Capital punishment to rapists in public place will be a deterrent: JIH Secretary
New Delhi: National Secretary of Jamaat-e-Islami Hind, Mr. Mohammad Saleem Engineer has demanded the harshest punishment to culprits of heinous crimes like rape saying only such punishment could be one of deterrents for the potential culprits. He was delivering special weekly lecture on Saturday at the Jamaat headquarters.
Speaking in the context of the recent incident of gang rape of a 23-year-old medical student in Delhi, Mr. Saleem drew the attention of the learned audience to various aspects of the issue and called for a holistic approach to the issue.
Talking about the reasons of the steep rise in sex crimes against women in India in recent years, Mr. Saleem elaborated on the social and cultural causes as well as the lacunae in the prevalent laws and legal system. He highlighted the criminal laws of Islam and urged Muslims to spread both the message and wisdom of the Islamic laws that successfully check crimes in the society.
As social reasons of sexual crimes, Mr. Saleem mentioned invasion of western culture of nudity and vulgarism, Corporate culture, industrialization of fashion, Call centre culture, Capital imperialism that has brought flood of cosmetics and products of fashion, alcoholism and drug addiction. TV and film industry, he said, are also promoting sexual violence, nudity and vulgarism in the society.
Coming down heavily on the government, JIH Secretary said the Governments have not been taking such incidents very seriously, rather they have promoted bar culture and opened wine shops – these all eventually lead to crimes.
About Indian criminal laws particularly those that deal with sex crimes like rape, Jamaat leader said such laws in India are very weak. These laws do not support victims, rather put the burden of proving victim on victims themselves while victims take weeks and months to come to senses after such heinous assault. He also said that laws give opportunity to criminals to protect themselves.
Mr. Saleem said the process of justice in our country is long and complicated and this is the reason that culprits manage release with the help of money and political connections. Some 99% of victims come from weaker sections, and they are not in position to take on the culprits and raise voice against them. Moreover, political connection and corruption in police and judiciary also helps the culprits. He said the actual number of such sexual crimes in India is far higher than that reported to the police.
The maximum punishment for rape in India is 7 years imprisonment. There should be capital punishment for such crimes, said Mr. Saleem adding that the culprits should be punished publicly to deter the potential culprits. Like crime is publicized punishment should also be publicized. The legal process should be fast and law should be harsh, he said.
Giving examples of some Muslim countries, he said that though there are many evils in Muslim countries but the number of sexual crimes like rape is very low there thanks to the fast legal system and stringent punishment.
He said Islam checks the sources of such crimes and gives harsh punishment to culprits if such incidents happen. The Islamic laws are based on justice and equality and are according to the nature. Muslims should spread the wisdom and logic of Islamic criminal laws, Mr. Saleem said.
Ameer (National President of Jamaat) Maulana Syed Jalaluddin Umri presided over the program. He took questions of the audience regarding Islamic criminal laws and explained their wisdom and logic and how they are able to check crimes.

I really appreciate the statement came from Janab Saleem Sb. All media and mob are targeting for the harshest punishment for those rapist however we all also need to focus on the root cause (social and cultural activities) of these incidents and how we should stop these kind of incidents in future.

Timely action to educate the masses regarding Islamic laws and punishments against rapes and sexual harrasments will go a long way in Indian History. Sexual crimes have gone up in India in general and Delhi in particular where we have a lady chief minister and also the seat of central Government. If Delhi is not free from such crimes how can we expect other cities to safe? I am confident JIH will avail this opportunity to place its point of view with the help of Quran and sunnah to the indian mass.

16 दिसम्बर 2012 की रात भारत की राजधानी नई दिल्ली में चलती बस में 6 लोगों ने मिलकर एक लड़की का सामूहिक बलात्कार कर दिया जो अपने ग़ैर-महरम पुरुष मित्र के साथ फ़िल्म देख कर कहीं जा रही थी। नई दिल्ली में घटित इस सामान्य नैत्य घटना के बाद पूरे देश में विरोध-प्रदर्शन पूर्णता असामान्य है। लोकतंत्र के नाम पर सड़कों पर हो-हल्ला करके बलात्कारियों को फ़ाँसी की सज़ा देने की बात करने वाले अशिक्षितों के साथ जमीअ़त उलेमा-ए-हिंद और जमाअ़त-ए-इस्लामी हिंद भी शामिल है। भारत में बलात्कार की यह कोई प्रथम घटना नहीं है और न अंतिम। इस घटना के बाद जारी विरोध-प्रदर्शन के बीच भी सामूहिक बलात्कार का नैत्य कार्यक्रम सामान्य रूप से जारी है। लेकिन 16 दिसम्बर 2012 की घटना के अपराधियों से ही इतनी घृणा क्यों? 16 दिसम्बर 2012 को चलती बस में सामूहिक बलात्कार का शिकार लड़की से ही इतनी सहानुभूति क्यों? दलितों और मुसलमानों की लड़कियों के साथ भी सामूहिक बलात्कार होता है, लेकिन उस पर न तो अशिक्षितों की भीड़ अपराधियों को सज़ा देने की मांग लेकर सड़क पर उतरती है और न जमीअ़त उलेमा-ए-हिंद व जमाअ़त-ए-इस्लामी हिंद के नेता अपने-अपने कार्यालयों से अपराधियों को सज़ा देने का बयान जारी करते हैं। सज़ा भी इस्लामी क़ानून के अनुसार दिए जाने की मांग की जा रही है। इस तरह की मांग केवल अशिक्षित करते तो बात समझ में आती है कि वह अशिक्षित हैं। जमीअ़त उलेमा-ए-हिंद और जमाअ़त-ए-इस्लामी हिंद के विद्वान नेता भी अशिक्षितों की हाँ में हाँ मिला रहे हैं। क्या इस्लाम में उस लड़की के लिए कोई सज़ा नहीं जो गैर-महरम मर्द के साथ बिना परदा आधी रात को फ़िल्म देख कर सड़कों पर मज़े करे। सामूहिक बलात्कार की शिकार लड़की को ग़ैर-महरम मर्द के साथ आधी रात को सड़क पर मज़े करने, बिना नक़ाब बाहर निकलने और फ़िल्म देखने की इस्लामी सज़ा की मांग क्यों नहीं किया गया? क्या इस्लामी क़ानून में यह कोई अपराध नहीं या इस्लामी क़ानून उच्च जाति वालों के लिए नहीं?
Jamaat should capitalise the situation by organising a national campaign on women issues, instead of closed room lectures. Now the environment is receptive to the teachings of Islam with some hindu mahants demanding shariah law, one hindu scholar from thanjavoor suggesting purdah, and the general public demanding capital punishment. Its time to act and pursue dawah activities rigorously.
